By accessing and using the Artwarmlight website and services, you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use our services.

Our online painting and drawing school provides educational content and courses for adult learners. You agree to:

All content on this website, including course materials, text, graphics, logos, images, and software, is the property of Artwarmlight or its content suppliers and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from our content without express written permission.

User Content

When you submit artwork, assignments, or other content to us:

• You retain ownership of your original work
• You grant us a license to use, display, and share your content for educational and promotional purposes
• You represent that your content does not infringe on any third-party rights
• We reserve the right to remove any content that violates these terms

Limitation of Liability

To the fullest extent permitted by applicable law, Artwarmlight, its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, data, or business opportunities
• Loss of goodwill or reputation
• Cost of substitute services
• Any other intangible losses

Our total liability to you for all claims arising out of or relating to your use of our services shall not exceed the amount you paid to us for the specific course or service giving rise to the claim in the twelve (12) months preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

Modifications to Services

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time without prior notice. This includes, but is not limited to:

• Changing course content, structure, or availability
• Modifying website features and functionality
• Suspending or discontinuing specific courses or services
• Updating pricing and payment terms
• Changing technical requirements or platform specifications

We are not liable to you or any third party for any modification, suspension, or discontinuation of services. If we discontinue a course you have enrolled in, we will make reasonable efforts to provide you with access to equivalent content or a refund in accordance with our Return Policy.

Termination

We may terminate or suspend your access to our services immediately, without prior notice, for any breach of these Terms of Use, including but not limited to:

• Violation of these Terms of Use or any applicable laws
• Fraudulent, abusive, or illegal activity
• Unauthorized access or use of our services
• Sharing account credentials or course materials with unauthorized parties
• Non-payment of fees
• Any other conduct that we determine, in our sole discretion, is harmful to our business, other users, or third parties

Upon termination:

• Your right to use the services will cease immediately
• You will lose access to all courses and course materials
• We may delete your account and all associated data
• Any outstanding fees remain due and payable

You may terminate your account at any time by contacting us. Upon termination by you, you will continue to have access to purchased courses until the end of the access period specified at the time of purchase, unless otherwise stated.

Dispute Resolution

If you have any concerns or disputes regarding these Terms of Use or our services, we encourage you to contact us first to resolve the matter amicably. Please contact us at info@artwarmlight.world with a detailed description of your concern.

If we cannot resolve a dispute through direct communication within 60 days, you agree to attempt to resolve the dispute through good faith negotiations before initiating any formal legal proceedings.

Binding Arbitration: Any disputes, claims, or controversies arising out of or relating to these Terms of Use, our services, or the breach, termination, enforcement, interpretation, or validity thereof, shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules, except where prohibited by law.

Arbitration Process: The arbitration will be conducted in New York, New York, United States, and will be conducted in the English language. The arbitrator's decision will be final and binding, and judgment on the arbitral award may be entered in any court having jurisdiction.

Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.

Exceptions: This dispute resolution provision does not prevent either party from seeking injunctive or other equitable relief from a court of competent jurisdiction to prevent irreparable harm or to preserve the status quo pending resolution of the dispute.

Applicable Law

These Terms of Use shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms of Use will be brought exclusively in the federal or state courts located in New York, New York.
